What comes to mind when you think of grade-school lunches?

Chicken patties, roast beef, meatloaf, mashed potatoes?

Growing up, I always enjoyed heading to the lunch line, especially on the days you knew the main course included healthy portions of meat. Most kids seemed to have at least one favorite item on the lunch menu, and for me it was chicken patties.

On the flip side, there were days that I went without meat, but it was always by choice — never a forced decision.

Part II: HSUS’s Two-Face Stance on State’s Rights

In Part 1 of our “Animal Rights and the Farm Bill” blog series, we highlighted the importance of Iowa Congressman Steve King’s Protect Interstate Commerce Act (PICA) that was presented as a much needed amendment to the 2013 Farm Bill. The PICA amendment (PICA) would reinforce the authority the U.S. Constitution gives to Congress to regulate interstate commerce.

Congressman King’s amendment is intended to protect the rest of America from anti-agricultural extremists and radical animal rights schemes that ban products from certain states that don’t meet arbitrary labeling or segregation standards.  For the past two years, HSUS has advocated and lobbied for what has been called a “one-size-fits-all” farm takeover bill – widely known as the “Egg Bill.”

We’ve discussed the severe ramifications of implementing HSUS’s “Egg Bill” in previous posts.

Wayne Pacelle, C.E.O. of HSUS, recently made this contradictory statement regarding the U.S. House Agriculture committee’s adoption of Congressman King’s PICA amendment,

“…we are deeply distressed by the House committee’s support for the amendment to eviscerate the powers of the States to establish and maintain laws governing food safety, animal welfare, environmental and worker protections. This is a threat to every consumer and to every animal in American agriculture, and it is an attack on the 10th Amendment to the Constitution and an almost unheard-of power grab by the Congress.” 

Did you catch the hypocrisy?

On one hand, Pacelle’s asking for a complete federal takeover of America’s egg production standards, and then, not two weeks later, he’s quoted saying the PICA amendment is an “almost unheard-of power grab by the Congress.”

An “unheard-of power grab” is precisely what HSUS was calling for in the “Egg Bill.”

The PICA amendment reasserts Congress’ authority given to them by the U.S. Constitution to prevent state protectionism. Contrary to Pacelle’s lies, the PICA amendment doesn’t “eviscerate” state’s rights, it upholds them.

Pacelle knows what’s at stake, and that’s his life’s work:

“We are going to use the ballot box and the democratic process to stop all hunting in the United States. We will take it species by species until all hunting is stopped in California. Then we will take it state by state.” – Pacelle, Full Cry Magazine

So it’s “ok” to trample state’s rights by passing crippling federal mandates that would harm America’s food producers and consumers in every state, but it’s a tragedy when Congress takes action to uphold their duty to “support and defend the Constitution of the United States?”  Pacelle thinks he deserves the ultimate authority and final say on issues concerning animal care standards. He only seems to champion state’s rights when he isn’t getting his way.

Part 1: Congressman King’s PICA Amendment

The battle between anti-food producers and traditional America has made its way into the Farm Bill.

In 1933, Congress created the Farm Bill to alleviate extremely low commodity prices. Since then, Congress has been tasked with re-evaluating the Farm Bill every five years. Today, the Farm Bill is more than 1,700 pages in length.

Last year, Congress delayed final actions on the 2012 Farm Bill with a yearlong extension set to expire September 30th, 2013.  Congress is taking action in order to meet the set deadline, and within the past month, the U.S. House and Senate have each passed their own versions of the Farm Bill through their respective committees on agriculture.

During the House Committee Farm Bill debate, more than 100 amendments were presented and one in particular deserves special attention – Iowa Congressman Steve King’s proposed Protect Interstate Commerce Act amendment.

According to Congressman King’s official statement, he’s, “… pleased that the Committee passed my amendment, the Protect Interstate Commerce Act (PICA) because states are entering into trade protectionism by requiring cost prohibitive production methods in other states.”

The PICA amendment passed with strong bi-partisan support in defeating a California amendment that aimed to gut the PICA amendment (13 Yes -37 No). Chairman Frank Lucas, former Chairman Bob Goodlatte and Chairman Collin Peterson led the effort in support of Cong. King’s vital legislation.

Simply put, the proposed PICA amendment reinforces the authority the U.S. Constitution gives to Congress to regulate interstate commerce. The PICA amendment would prohibit any one state from enacting laws that dictate agricultural production methods within another state.

The fact that this amendment is needed now is ridiculous. This is a protection that was guaranteed with the penning of the Commerce Clause  in our Constitution over 200 years ago.  But, with increased pressures and overreaching authority claimed by animal rights groups and detractors of new farm technology to dictate state laws and regulations for animal agriculture, such action from Congress is necessary.

Passing laws that ban products from other states, that don’t meet your state’s standards,  or demanding costly arbitrary labeling and segregation mandates are examples of the very type of abuse that the Commerce Clause was intended to prevent. New schemes from radical activists and their liberal supporters in states like California and New York should not be allowed to destroy the economies of other states or create a market that entirely favors products made only in their states.

Congressman King’s amendment has received strong support from agriculture groups, like the National Cattlemen’s Beef Association (NCBA.) Scott George, President of NCBA, was recently quoted by the Oklahoma Farm Bureau, saying, “We are encouraged by the amendment introduced by Rep. King, which would keep decisions regarding how to raise livestock and poultry in the hands of farmers and ranchers, where they belong.”

With world food production required to double by 2050 to feed the world, new technology and farming practices will be more vital than ever. It is critical that we become more productive to keep food safe and affordable. The results of undermining productivity in a world that has 880 million people under-nourished would be tragic.
